The Apple iPhone 5 is still yet to arrive, but Samsung has apparently drawn up a legal move for the company to block the sale of the fifth-generation iOS smartphone in South Korea once it is launched, according to a report.

The report comes from Korea Times, which said that “Sources closely involved with the thorny issue including Samsung insiders made the comments Sunday.”

An unnamed source, described by the news publication as a Samsung Electronics senior executive, said that after the arrival of the iPhone 5 in South Korea, the company plans to take Apple Inc. to court for violation of wireless technology related patents from Samsung. “For as long as Apple does not drop mobile telecommunications functions, it would be impossible for it to sell its i-branded products without using our patents. We will stick to a strong stance against Apple during the lingering legal fights,” the executive stated.

The Korea Times report is the latest in the ongoing legal battle between Samsung Electronics and Apple. Over the last few months, both companies have ramped up their patent battle, taking it to every major country in the world. As of now, Apple and Samsung are battling it out across Europe, the United States, Australia and in some parts of Asia.

In Australia, Samsung has agreed to show Apple three Galaxy Tab 10.1 designs before it sells the version that the Cupertino tech giant allows. Earlier this month, Apple has successfully stopped the sale of the tablet in Germany.
